Terms of Service
These Terms of Service ("Terms") govern your access to and use of MerchantMe's website (merchant-me.online) and merchant processing services. By applying for or using our services, you agree to these Terms.
1. Services
MerchantMe provides payment processing facilitation, merchant account services, and related tools. Our services are subject to approval by our banking and processing partners. We reserve the right to decline any application at our sole discretion.
2. Eligibility
You must be at least 18 years of age and legally authorized to operate your business to use our services. By applying, you represent that all information provided is accurate, complete, and current.
3. Prohibited Activities
You may not use MerchantMe services for transactions involving:
- Illegal goods or services under applicable federal, state, or local law
- Fraudulent, deceptive, or manipulative activity
- Unlicensed financial services or money transmission
- Activities that violate card network rules (Visa, Mastercard, Amex, Discover)
- Any activity that poses excessive chargeback or fraud risk
4. Fees and Payments
Fees are disclosed in your merchant agreement. You authorize MerchantMe to deduct applicable fees from your settlement funds or to charge your designated bank account. Fee schedules are subject to change with 30 days' notice.
5. Chargebacks and Disputes
You are responsible for all chargebacks, reversals, and dispute fees arising from your transactions. MerchantMe may hold reserves or withhold settlement to cover potential chargeback exposure. Excessive chargebacks may result in account suspension or termination.
6. Account Termination
You may close your account at any time with 30 days' written notice. MerchantMe may suspend or terminate your account for violations of these Terms, excessive chargebacks, fraud risk, or regulatory requirements. There is no early termination fee.
7. Limitation of Liability
To the fullest extent permitted by law, MerchantMe shall not be liable for indirect, incidental, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the fees paid to us in the three months preceding the claim.
8. Indemnification
You agree to indemnify and hold harmless MerchantMe, its officers, employees, and partners from any claims, losses, or expenses (including legal fees) arising from your use of our services or violation of these Terms.
9. Dispute Resolution
Any disputes arising under these Terms shall be resolved by binding arbitration under the rules of the American Arbitration Association, conducted in English in the State of Delaware. Class action waivers apply.
10. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
11. Changes to Terms
We may modify these Terms with 30 days' notice. Continued use of our services after changes constitutes acceptance of the revised Terms.
